well since it's not illegal to chip/jailbreak phone's/consoles in many countries what Apply are doing is technically illegal as it is damaging people's good they have purchased.

i smell a class action lawsuit following.

While modding may be legal, microsoft don't like people doing it. In their favour though, they don't lock down the console so it can't be used. The just ban access to xbox live.

This will hurt them more than anything.
